Sales and delivery conditions Van de Haar Guitars and Parts – File no. 30151885

  1. Delivery conditions

1.1 By placing an order with Haar Guitars, either verbally, in writing, by e-mail, via the website, or in any other way, you agree to the delivery conditions of Haar Guitars.
1.2 Our delivery conditions are not deviated from, unless otherwise agreed in writing.

 

  1. Agreement

2.1 The prices published by Haar Guitars or otherwise provided, whether online, verbally, in writing, or in any other way, are without obligation. Haar Guitars reserves the right to change prices.
2.2 An agreement is only concluded after acceptance of an order by Haar Guitars. Haar Guitars reserves the right to refuse orders or to attach certain conditions to the delivery, with regard to the nature and quantity.
2.3 If Haar Guitars does not accept an order or wishes to attach conditions to the delivery, this will be communicated to the customer concerned within  ten days of receipt the order.
2.4 After placing an order with Haar Guitars, an order confirmation will be sent to the customer concerned. The customer must confirm this order confirmation again if Haar Guitars requests this. This is to protect the customer. After confirming the order confirmation, the order is final and will only then be processed by the Haar Guitars administration. In most cases, orders are simply processed and confirmation of the order is not necessary.

 

  1. Prices and payment

3.1 If the prices of the products from Haar Guitars appear  to be higher than stated on the website or otherwise, the customer will receive a message about this when ordering. The customer is entitled to cancel the order in this situation, provided that this is done within 3 days after sending the message.
3.2 The prices as stated tot he dealers excluding 21 % VAT
The prices of the products on the website are shown in Euros and include VAT of the delivery countries. However no right scan be derived from these prices
3.3 Payments is made in advance, in cash, or on account. Haar Guitars is entitled to choose one of these payment methods as a condition for delivery without giving reasons.
In certain cases, deliveries from Haar Guitars can be made on account, at the discretion of Haar Guitars. If delivery is made on account, the enclosed invoice must be paid within 30 days after delivery, unless otherwise agreed. The date of payment is the date on which the amount is credited to our account.
3.4 In the event of bankruptcy, the buyer is obliged to make the unpaid goods still in our possession available to us at our first request, without prejudice to our right to compensation without any judicial intervention. The client is jointly and severally liable for payment of the invoice amount.

 

  1. Delivery

4.1 Delivery of the ordered products will in principle be from stock. However, as soon as the relevant products are not in our possession, we will inform the buyer and provide an expected delivery time. This timeframe depends on various factors. We are committed to delivering as quickly as possible!
4.2 A long delivery time for specific products does not in any case entitle the customer to compensation, in any form whatsoever. If Haar Guitars anticipates a long delivery time, this will be communicated to the customer in question. If Haar Guitars anticipates that delivery within a reasonable period is not possible, the customer will be given the choice to cancel or maintain the order.

 

  1. Retention of title

5.1 The products ordered by the customer will only become the property of the customer if all payment obligations and other conditions have been met. Until that time, Haar Guitars retains ownership of the goods.
5.2 At the time of delivery of the products from Haar Guitars to the customer, the customer is responsible for any damage that occurs after the products have been delivered. 

 

  1. Liability

6.1 The customer is obliged to examine the products upon delivery to see if there are any imperfections in the product and whether the delivered products comply with the agreement. If this is not the case, the customer must inform Haar Guitars of this in writing with justification within two days.
6.2 If it is demonstrated that the products do not comply with the agreement, Haar Guitars has the choice to replace the products in question with new products upon return, or to refund the invoice value there of to the customer.
6.3 Products that do comply with the agreement cannot be returned, unless otherwise agreed in writing. In the event that the shipmentr eturned after written permission from Haar Guitars, all costs incurred are for the account of the customer. Furthermore, the packaging and the product must be undamaged. Any damage will be charged to the customer.

 

  1. Orders / communication

7.1 Misunderstandings that occur through the use of modern means of communication, such as the internet and e-mail, with orders and communications cannot be recovered from Haar Guitars.

 

  1. Force Majeure

8.1 In the event of force majeure, Haar Guitars reserves the right to suspend or cancel orders. Haar Guitars is obliged to inform the customer of this. Haar Guitars is not liable for the consequences that arise from the suspension or absence of an agreement.
8.2 Force majeure means that there is a shortcoming that cannot be attributed to Haar Guitars, because it is not due to its fault.

 

  1. Communication

Misunderstandings that occur through the use of modern means of communication, such as the internet and e-mail, with orders and communications cannot be recovered from Van de Haar Guitars and Parts.

 

  1. Cancellation

Cancellation of an order/assignment must be stated in writing. All materials already purchased will be charged to the purchasing party.
In case of cancellation, the down payment will not be refunded.

 

  1. Warranty

Repairs will only be analysed if it occurs within 2 year from the delivery date; the delivery date is used as the reference date.
The invoice must be sent with the product and include a clear description of the problem and/or complaint.
Defects resulting from:

  • Failure to comply with the provisions of the user manuals and installation instructions
  • Improper use of the product
  • Repairs or attempts to do so by the purchaser or third parties
  • Damage by the purchaser or third parties
    “Tubes of the amplifiers are not covered by the warranty”

 

  1. Dutch Law / Disputes

These sales conditions are binding.
This agreement is exclusively governed by Dutch law.
Any dispute that may arise will be referred to the competent court in Utrecht.

 

  1. Other

13.1 Haar Guitars is entitled to enforce these conditions in full.
13.2 Haar Guitars reserves the right to use the services of third parties when executing orders.
Price quotes, transactions, and deliveries are made in accordance with the delivery conditions. A copy will be sent to you upon request.
